These Terms of Service (“Terms”) govern your access to and use of the services provided by Crescos AI (“we,” “us,” or “our”). By using our services, automations, chatbots, or website, you agree to be bound by these Terms.

If you do not agree to these Terms, you may not use our services.

1. Service Description

Crescos AI provides automation solutions, AI chatbots, sales follow-up systems, and workflow optimization services for home service businesses and other commercial clients. Services may include setup, customization, ongoing automation monitoring, and subscription-based software access.

2. Eligibility

Our services are intended for business and commercial use only.
By using our services, you confirm that:

You are entering into this agreement on behalf of a business or organization

You are at least 18 years old

You have authority to bind the business to this agreement

3. Account Registration

To access certain features, you may need to create an account. You agree to:

Provide accurate and complete information

Maintain the confidentiality of your login credentials

Notify us immediately of unauthorized account use

You are responsible for any actions taken through your account.

4. Payment Terms

Our services are offered on a subscription basis. Pricing, scope, and deliverables will be outlined in your individual service agreement, proposal, or onboarding contract.

Payments are billed through Stripe or as otherwise agreed

Payments must be made on time to maintain access to services

Late or failed payments may result in suspension of service

Refund Policy — Performance-Based Guarantee

If we fail to deliver the agreed-upon outcomes defined in your service scope (for example: specific automation workflows, delivery timelines, or implementation results), you may request a refund.

Refunds are evaluated based on documented deliverables, communication, and effort performed.

Refunds are not provided for:

Lack of client response or cooperation

Changing your mind after work has begun

Situations where required access/materials were not provided on time

5. Acceptable Use

You agree not to use our services to:

Engage in unlawful, abusive, fraudulent, or misleading activities

Send spam or unsolicited mass communications

Collect or process sensitive personal information without consent

Attempt to reverse engineer, copy, or replicate our proprietary workflows, automations, or internal systems

We may suspend or terminate service if misuse occurs.

6. Intellectual Property

All software, systems, workflows, automation setups, documentation, branding, and AI prompt frameworks created by Crescos AI remain our intellectual property.

You receive a license to use these systems while you are an active paying customer.
You may not resell, reproduce, or reuse our proprietary materials outside your organization.

Your data, contacts, and business information remain your property.

7. AI Output Disclaimer

Our AI systems generate responses based on provided data and model behavior.
We do not guarantee the factual accuracy of any AI-generated outputs.

You agree:

To review AI outputs before sending to customers or the public

That we are not liable for financial, legal, or reputational consequences caused by AI-generated content

To use AI systems responsibly and in accordance with your local laws

8. Limitation of Liability

To the fullest extent permitted by law:

We are not liable for indirect, incidental, special, or consequential damages

Our total liability is limited to the amount you have paid to us in the past 3 months

Nothing in these Terms limits liability for intentional misconduct or fraud.

9. Service Modification and Termination

We may update or improve our services at any time. We may suspend or terminate access if:

Payments are not made

Terms are violated

Abuse or misuse occurs

You may cancel your subscription at any time.
Upon cancellation, access to services and automations may stop immediately unless otherwise stated in your contract.

10. Governing Law

These Terms are governed by the laws of Ontario, Canada.
Disputes will be resolved in the courts located in Ontario.
